Definitions & Terms Used
“Program” means the Event Hospitality & Entertainment Ltd Hotels & Resorts Gift Card and Voucher Program, as governed in accordance with these Terms and Conditions;
Gift Card means a QR coded card (digital or physical) featuring a stored dollar value (Gift Dollars) issued to the Customer ranging from $100 to $1,000 available in AUD or NZD.
Gift Voucher means an electronic voucher or certificate featuring a stored dollar value or value-add package or experience (Gift Dollars) issued to the Customer via Hotel branded websites.
“Promoter” means Event Hospitality & Entertainment Ltd in its capacity as manager of the Program in conjunction with its authorised fulfilment agencies.
“Program Accommodation, Food & Beverage, Experiences and Services” means principally hotel accommodation and meals and/or bar expenses (if applicable) plus ancillary services and packages provided by Participating Hotels in the Program which Customers may redeem using their Gift Dollars.
“Purchaser” means a customer that orders and purchases a Gift Card or Gift Voucher from the Promoter pursuant to the Program on behalf of a Customer.
“Customer” means a customer who has been issued with a Gift Card or Gift Voucher by either the Promoter or Purchaser pursuant to the Program and is the specified holder of the Gift Card or Gift Voucher.
“Gift Dollars” means the pre-determined nominated dollar value, experience or package value which is pre-loaded on to the Gift Card or Gift Voucher at the time of issue. The amount of Gift Dollars pre-loaded on each Gift Card or Gift Voucher is specified on the back of the physical card, on the top right hand corner of the digital card or in the body of the electronic PDF or email accompanying the voucher. The card is to be treated with the same care and security as cash. If lost or stolen, Gift Cards or Gift Vouchers cannot be replaced.
“Experiencethis” and www.experiencethis.com.au means the retail & online voucher store (a wholly owned subsidiary of Event Hospitality & Entertainment) and responsible for issuance, dispatch, delivery and dispute resolution of Gift Cards and Gift Vouchers.
“Smart Visit Solutions” means the technology and program partner responsible for issuance, dispatch, delivery and dispute resolution of Gift Cards.
‘Groups360’ means the electronic technology platform responsible for the issuance, dispatch and delivery of Gift Vouchers.
The card remains the property of the Promoter.
Definitions & Terms UsedUse of Gift Card or Gift Voucher at Participating Hotels
Gift Cards and Vouchers are used primarily to redeem Program Accommodation, Experiences and Food & Beverage products and services at Participating Hotels. Customers may make a booking or reservation at a Participating Hotel by either calling the hotel direct or directly online via www.rydges.com, www.aturahotels.com or www.qthotels.com.
Accommodation reservations require a valid credit card number to guarantee & confirm the reservation. Upon check-in the Customer should present the original Gift Card or Gift Voucher and inform staff if they wish to redeem the Gift Dollars in exchange for Program Accommodation, Experiences and Food & Beverage or Services. Upon check-out, the credit card advice will be destroyed or deleted if the Customer redeems the final account utilising the Gift Dollars stored on their Gift Card or Gift Voucher.
Copies of Gift Cards or Gift Vouchers will not be accepted. Gift Cards and Gift Vouchers will be deemed void if altered in any way. A Participating Hotel may refuse to accept a damaged Gift Card or Gift Voucher or if it reasonably suspects the card or voucher has been altered, stolen, defaced or is being used in a criminal or fraudulent manner.
Gift Cards and Gift Vouchers and associated Gift Dollars, or Program Accommodation, Experiences and Food & Beverage or Services bought with them, are not redeemable for cash or credit card transactions, hotel line of credit nor hotel accounts.
If there are sufficient Gift Dollars on a Customer’s Gift Card or Gift Voucher to redeem the selected Program Accommodation, Experiences and Food & Beverage or Services in full, the Gift Dollars cannot be used in conjunction with part-cash payments. If there are insufficient Gift Dollars on the Customer’s card or voucher to redeem the selected Program Accommodation, Experiences and Food & Beverage or Services in full, then the balance may be settled by the Customer with a cash or credit card payment.
Participating Hotels may change over time (as determined by the Promoter in Its absolute discretion). A list of current participating hotels can be found online at www.rydges.com/gift-cards, www.aturahotels.com/gift-cards or www.qthotels.com/gift-cards. Participating Hotels listed are correct at the time of the publication and it remains the sole responsibility of a Customer to check prior to making the reservation if a particular hotel is a Participating Hotel in the Program prior to making the reservation.
Thredbo Alpine Hotel and Thredbo Resort are NON Participating Hotels and Resorts.
Gift Dollars can be used to redeem Program Accommodation, Experiences, Food & Beverage and Services, meals, bar tabs, room service and other services that can be charged to a guest account folio at Participating Hotels. Any other travel costs and expenses incurred are the sole responsibility of the Customer.
Gift Cards or Gift Vouchers may not be “topped up” with additional Gift Dollars to those already pre-loaded onto the Gift Card or Gift Voucher at the point of issue. Additional Gift Dollars will require the purchase of a new Gift Card or Gift Voucher and associated Gift Dollars, in accordance with these Terms and Conditions. A Customer can redeem Gift Dollars in exchange for Program Accommodation, Experiences and Food & Beverage and Services from multiple (two or more) Gift Cards or Gift Vouchers at the same time.
Reservations at Participating Hotels remain subject to availability at the time of booking. No guarantee can be given that a particular room will be available at any Participating Hotel on or for the days that the individual Customer may prefer.
Customers can cancel a reservation; however they must do so by contacting the applicable Hotel directly and advising them of the cancellation (“Cancellation Notice”) within the cancellation period. Customers may be required to pay a cancellation fee if the booking is not cancelled within the Hotel’s cancellation period.
Gift Cards or Gift Vouchers cannot be bought & re-sold by3rd party auction sites. Any Gift Cards or Gift Vouchers found for sale on such sites will be deemed null and void and electronically cancelled.
Purchase & Payment of Gift Cards and Gift Vouchers
Purchase of physical Gift Cards can be conducted at the front desk of participating Hotels. Digital Gift Cards and Gift Vouchers can be purchased at www.rydges.com/gift-cards, www.aturahotels.com/gift-cards or www.qthotels.com/gift-cards. Online orders must be purchased using a valid credit card.
Gift Cards and Gift Vouchers are distributed when full payment (of the amount equating to the number of Gift Dollars pre-loaded on the card or voucher, in each case) is received by the Promoter (including any service, transaction fees or postage charges) in accordance with these Terms and Conditions. Refunds and exchanges are not available after full payment is received.
Currently accepted credit cards for payment of Gift Cards include Visa, MasterCard American Express & Diners Club.
Gift Cards and Gift Vouchers are issued in Australian and New Zealand Dollars only.
All prices are inclusive of GST unless otherwise stated. Any other taxes, charges, fees or duties that are, or may be levied on such prices or Program Accommodation, Experiences and Food & Beverage or Services must be paid for by the Purchaser unless otherwise stated.
The Promoter is not responsible for inaccurate or incorrect information supplied during the Gift Card or Gift Voucher purchase process, either caused by the Customer or Purchaser or by any of the related Information Technology infrastructure \ platform nor programming associated with or used in this Program, or by any technical error that may occur in the course of the administration of this. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of orders and/or other information submitted in connection with this Program.
Expiry Date of Cards
All Gift Cards in Australia are valid for 36 months from the date of issue (“Validity Period”). No standard validity periods exist in NZ but the 36 month validity period will also be extended to Gift Cards issued in NZ.
The 36 month validity period does not apply to gift cards or vouchers that are:
- able to be reloaded or topped up
- donated for promotional purposes
- available only for a specified period or event
- supplied at a genuine discount (e.g. $60 card for a dinner valued at $100)
- part of an employee reward scheme
- part of a customer loyalty program
- second-hand gift cards
- part of a temporary marketing promotion
If the Customer does not fully redeem all of the Gift Dollars on a Gift Card or Gift Voucher for Program Accommodation, Experiences and Food & Beverage or Services within the Validity Period, they may apply for an extension of the Validity Period by making written application to the Program Manager at [email protected] no later than 1 month prior to the expiry of the Validity Period as indicated upon the Gift Card or Gift Voucher.
Application for extensions must clearly contain the following information:
- why an extension to the Gift Card or Gift Voucher is being required
- the identification number of the Gift Card or Gift Voucher and
- the expiry date of the Gift Card or Gift Voucher.
The Promoter reserves the right to grant a Customer an extension of the Validity Period at its absolute discretion but is not bound to do so.
If an extension to the Validity Period is granted by the Promoter, it remains the Customer’s duty to return the Gift Card to the Program Manager at [email protected]. The Program Manager will then arrange for a new Gift Card or Gift Voucher to be issued in replacement of the old one (with remaining balance of the Gift Dollars on the old card or voucher transferred to the new Gift Card or Gift Voucher) and the extended Validity Period will be recorded on the new Gift Card or Gift Voucher.
Stolen or Lost Cards
In the event of a Gift Card or Gift Voucher being lost or stolen, a Customer is not entitled to a cash refund of any unused “Gift Dollars’. They should contact the Program Manager at [email protected] directly.
The Promoter will not accept any responsibility for stolen, lost, damaged or wilfully defaced Gift Cards or Gift Vouchers or for any unauthorised or fraudulent use thereof.
To the extent permitted by law, the Promoter, its authorised agents and Participating Hotels, make no representations, warranties or conditions of any kind, express or implied with respect to the Gift Card or Gift Voucher. The Promoter does not represent or warrant that a Gift Card or Gift Voucher will always be accessible or accepted.
To the extent permitted by law, in the event that the Promoter, its authorised agents and Participating Hotels, are found liable to the Purchaser or Customer, they shall only be entitled to recover actual and direct damages and such damages shall not exceed the last balance held on that Customer’s Gift Card or Gift Voucher.
The Promoter, its authorised agents and Participating Hotels, shall have no liability for any incidental, indirect or consequential damages arising out of or in any way connected with the use of a Gift Card or Gift Voucher.
Certain legislation, including the Trade Practices Act 1974 (Cth), may imply warranties or conditions or impose obligations upon the Program Manager, the Service Providers and the Participating Hotels which cannot be excluded, restricted or modified or cannot be excluded, restricted or modified except to a limited extent. This agreement must be read subject to these statutory provisions.
If these statutory provisions apply, to the extent to which the Promoter, its authorised agents and Participating Hotels, are able to do so, their liability under those provisions will be limited, at their option to:
- in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods; the payment of the costs of replacing the goods or of acquiring equivalent goods; or the payment of having the goods repaired; or
- in the case of services, the supplying of the services again; or the payment of having the services supplied again.
In the event of any dispute or issue arising in regards to the Gift Card or Gift Voucher or any Program Accommodation, Experiences and Food & Beverage and Services purchased with the Gift Card or Gift Voucher, or any other dispute in relation to any matter concerning the conduct or administration of the Program, the Promoter may authorise the Program Manager to consult with the Customer or Purchaser (as the case may be) in order to resolve the dispute or issue, but this does not create an obligation on the Promoter to do so.
Any and all decisions of the Promoter in relation to any aspect of this Program will be final and binding on the Customer and Purchaser.
Acceptance of Terms
The submission or receipt of an order is deemed to constitute acceptance of these Terms and Conditions.
Right to Modify, Alter and Amend
These Terms and Conditions are subject to the specific terms and conditions of each Participating Hotel and all applicable laws in the country where the Gift Cards or Gift Vouchers are purchased.
The Promoter reserves the right to modify, change and alter any Terms and Conditions in its absolute discretion at any time without notice and without liability. The Promoter also reserves the right to terminate the Program in whole or in part in its absolute discretion at any time without notice and without liability. Any and all ‘live’ Gift Cards or Gift Vouchers within the marketplace will be honoured until the end of their Validity Period.
